He was indicted for murder in the first degree and the verdict and sentence was murder in the second degree and sixty years in the penitentiary. A motion for a new trial was overruled and appellant appealed. When arraigned in the circuit court, appellant pleaded not guilty and not guilty by reason of insanity.
